What is the Militia?

 

As defined by our founding fathers, the militia is defined as “the whole people”. It is every able-bodied citizen who is not disqualified by criminal conviction or mental defect, except those few persons who hold public office, such as judges, legislators, etc.

To put it in simplest terms, the militia is – all able bodied citizens who are capable of bearing arms. The last line of defense against any threat to the state or country, whether it be natural or man-made, foreign or domestic. Basically a civil defense or community watch group.

The Militia under the Pennsylvania Constitution falls under the following statutes. Many people do not realize that they are already in the militia as defined by state law.

THE MILITIA

Sec.

301.  Formation.

Enactment.  Chapter 3 was added August 1, 1975, P.L.233,

No.92, effective January 1, 1976.

§ 301.  Formation.

(a)  Pennsylvania militia.–The militia of this Commonwealth shall consist of:

(1)  all able-bodied citizens of the United States and all other able-bodied persons who have declared their intention to become citizens of the United States, residing within this Commonwealth, who are at least 17 years six months of age and, except as hereinafter provided, not more than 55 years of age; and

(2)  such other persons as may, upon their own application, be enlisted or commissioned therein.

(b)  Pennsylvania naval militia.–The naval militia of this Commonwealth, when organized pursuant to rules and regulations promulgated by the Governor, shall consist of those persons as may, upon their own application, be enlisted or commissioned therein.

 

Along with these statutes, the Governor of the State is also commander in Chief of the Militia and in time of emergency may draft as many people from the militia for service.

 

Why do we wear uniforms?

 

According to the US and Pennsylvania constitution and the Geneva Convention, members of a militia when in the performance of a militia, must be identifiable with a uniform and insignia, militia members must also have identification stating that they are part of a militia.
